Terms of Service
The terms for using Augis.
The contract that applies when you create an account, buy a plan and use the tools.
1Who we are and what these Terms cover
These Terms of Service (“Terms”) are the contract between you and Augis (“Augis”, “we”, “us”). They apply to the Augis website, the dashboard, the tools offered through it (today Parallax and Wake) and anything we add to them (together, the “Service”).
By creating an account, buying a plan or using the Service you accept these Terms. They include, and must be read with, the Privacy Policy, the Responsible Use policy. If you do not accept them, do not use the Service.
Definitions. A Plan is a paid subscription period. Credits are the units a Plan includes and that tools consume. A Result is what a tool returns for a lookup. A Report is a file Wake produces (PDF, CSV or JSON). A Lookup is any query you run with a tool.
2Eligibility and who you are contracting as
You must be at least 18 and have the legal capacity to enter a contract. If you use Augis for an organisation, you confirm that you have authority to bind it, and “you” then includes that organisation.
Augis is built for professional and investigative use. If you use it as a consumer, meaning an individual acting outside any trade or profession, the mandatory consumer rights of the country where you live are not affected by anything in these Terms, and the clauses below say where they apply.
Some functions may be opened only to verified accounts, for example to public authorities. We may ask for proof of identity, organisation, role and purpose, and may refuse or withdraw such access. Access to a restricted function is logged.
3The Service
Augis brings information from public sources, registries, public blockchains and breach indexes together into structured Results, lets you organise findings into cases and, with Wake, produces Reports about the movement of Bitcoin and Ethereum funds.
Features marked early access or “soon”, such as the API, are offered without any commitment on availability, timing or scope.
What the Service is not. Results and Reports are analytical aids. They are not legal advice, not a certified forensic or expert opinion, not an identity check, and not a credit, employment, insurance or tenancy assessment. A Result that matches an identifier does not prove that it concerns a particular person. Wake infers where funds went from public data and names addresses from lists that can be incomplete or out of date: a label is a lead, not proof of who controls an address. Whether a Report is accepted as evidence is for the court or authority concerned to decide, not for us.
4Your account
- Give accurate information and keep your password confidential.
- One account per person. Do not share sign-in details or let others use your credits.
- You are responsible for everything done through your account. Tell us without delay if you suspect unauthorised access, so that we can help secure it.
We may require stronger authentication or verification where the risk justifies it.
5Acceptable use
You may use the Service only for lawful and legitimate purposes, in line with the Responsible Use policy. You must not:
- stalk, harass, threaten, intimidate, extort or dox anyone, or target a private person without a legitimate reason;
- use the Service to take or support decisions about a person’s credit, employment, insurance, housing, education or eligibility for services, or any decision that produces legal effects for them;
- use credentials or personal data found through the Service to access accounts, systems or funds that are not yours;
- use Wake to hide, launder or move funds, to evade sanctions, or to send a request to an exchange or issuer that you know to be false or misleading;
- resell, redistribute, publish in bulk or scrape Results, or build a competing dataset or model from them;
- bypass rate limits, credit accounting, plan requirements or access controls, probe or test the Service’s security without our written permission, or reverse-engineer it except where the law allows;
- upload malicious code, or interfere with the Service or with other users;
- use the Service in breach of any law, including data protection, privacy, anti-stalking, sanctions and export control law.
Your own obligations when you look someone up. You decide why and how you use a Result. You are responsible for having a lawful basis for each Lookup, for keeping a record of that purpose where the law requires one, for informing the people concerned where the law requires it, for keeping Results secure and for deleting them when you no longer need them. For the personal data in Results, you are the controller of your own use; see the Privacy Policy for how we process data ourselves.
6Plans, credits and payment
Plans. Paid Plans last 30 days, or a year where a yearly option is offered. The price, the period and the credits included are shown before you pay. A Plan does not renew by itself: to continue, you buy a new period. A Plan is required to run Lookups; credits alone do not open the tools.
Credits. Credits included in a Plan are available during that Plan period and do not carry over unless the Plan says so. A Lookup consumes the number of credits shown for it (for example one credit for a Wake trace). If a Lookup fails because a data source fails, the credit is returned. Credits have no cash value and cannot be transferred. Additional credit purchases, where offered, are added to your balance and expire with the Plan period.
Payment. Payment is accepted in cryptocurrency only, through a third-party payment processor. Blockchain transactions cannot be reversed. If a payment does not confirm, or credits are not applied after confirmation, contact contact@augis.eu and we will resolve it. Taxes, including VAT where it applies, are handled as the law requires and shown at checkout.
Changes to prices. We may change prices or Plan contents for future periods. A change never affects a period you have already paid for.
Right of withdrawal (consumers). If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance contract. Because the Service is digital and starts immediately, at checkout you ask us to start straight away and you acknowledge that you lose the right of withdrawal once the Service has been fully performed, or, for a Plan, as soon as you have used the Service during the withdrawal period, to the extent that Article L221-28 of the French Consumer Code or the equivalent law of your country allows. If you withdraw before using it, we will refund you in the same cryptocurrency, at the value of the amount paid in your currency at the time of the order, less any network fees we cannot recover.
Refunds otherwise. Except where the law gives you a right to a refund, or we are in breach, completed payments are final.
7Third-party data, accuracy and your reliance on it
Results come from third parties and public sources we do not control. We do not promise that any Result is complete, accurate, current or lawful to use in your situation, or that a source will stay available. You must check a Result before relying on it, and above all before it affects another person.
Wake. Percentages are an estimate produced by the haircut method described in each Report, not proof that particular coins followed a particular path. Sanctions status changes over time: the current official listing prevails over anything we show. A Report’s fingerprint proves that the file has not been changed since it was produced; it does not prove that its content is correct.
Assistant. The dashboard includes an automated assistant that answers questions and can suggest an analysis, which runs only when you press its button and costs the credits that analysis costs. Its answers are produced automatically. They can be wrong or incomplete, they are not legal, financial or investigative advice, and you must check them before relying on them. You must not use it to harass, stalk or locate a private individual, and the rules of the Acceptable use section apply to it. We may limit its use.
Requests to exchanges and issuers. Wake can draft a freeze or review request. We never send it for you. You decide whether to send it, you are responsible for what it says and for the way you obtain and use any reply, and we have no control over whether a third party acts on it.
8Intellectual property and your content
Augis, its software, design, name, logo and the compiled address and label lists belong to us and our licensors. You receive a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose during your Plan.
You keep ownership of what you enter and save, such as case notes. You give us the permission needed to host and process it to run the Service for you. You may use Results and Reports in your own work, including as supporting material in a report, investigation or proceeding, provided you respect these Terms and the rights of the sources they come from. You may not resell them as a dataset.
If you send us feedback, we may use it to improve the Service without obligation to you.
9Data protection and confidentiality
How we handle personal data is described in the Privacy Policy. We do not read your saved cases or history as a matter of course. We may review activity where needed to investigate abuse, secure the Service or comply with the law, and we log access to restricted functions.
We may disclose data where a competent authority legally requires it, or where we need to protect people from serious harm. Where the law allows, we will tell you first.
If you need a data processing agreement for your organisation, ask through contact@augis.eu.
10Availability and changes to the Service
We work to keep the Service available, but it is provided on an “as available” basis and may be interrupted for maintenance, by failures of third-party sources, or for reasons outside our control. We may change, add or remove features. Where a change materially reduces what a paid Plan includes, we will give notice, and you may stop using the Service and ask for a pro-rata refund of the unused period if the change is to your detriment.
11Suspension and termination
We may restrict, suspend or terminate an account that breaches these Terms, particularly the rules on acceptable use, or that puts people or the Service at risk. Where reasonable we will tell you why and give you the chance to respond, except where that would be unlawful or unsafe. In that case we are not required to refund remaining Plan time or unused credits, unless the law says otherwise.
You can stop using Augis at any time and ask us to close your account through contact@augis.eu. Nothing locks you in. The clauses that by their nature should survive (intellectual property, liability, governing law) continue after termination.
12Warranties and disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Consumers. This does not remove the legal guarantee of conformity that applies to digital content and services (in France, Articles L224-25-1 and following of the Consumer Code), or any other warranty that the law gives you and that cannot be excluded.
13Limitation of liability
To the maximum extent permitted by law, Augis is not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service or from decisions made on the basis of Results or Reports.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury, for fraud, for intentional fault or gross negligence, or any other liability that cannot be excluded or limited by law.
14Indemnity
If you use the Service for business purposes, you agree to indemnify Augis against third-party claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the Service, including Lookups you ran without a lawful basis. This clause does not apply to consumers beyond what the law allows.
15Sanctions and export compliance
You confirm that you are not on a sanctions list, are not owned or controlled by a person on one, and will not use the Service from, or for the benefit of, a person or territory subject to comprehensive sanctions. We may restrict access where the law requires it.
16Events beyond our control
Neither party is liable for a failure or delay caused by an event outside its reasonable control, including failure of a data source, network or payment provider, cyber-attack, or a change in law or in the terms of a third-party data provider.
17Changes to these Terms
We may update these Terms as the Service and the law change. For a material change we will give at least 30 days’ notice, by a notice in the dashboard or on this page, and update the effective date and version. If you do not accept a change, you can stop using the Service before it takes effect and, if you are a consumer, ask for a pro-rata refund of the remaining paid period. Using the Service after the change takes effect means you accept it.
18Governing law, disputes and mediation
These Terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of your place of residence.
Please contact us first so that we can try to resolve a dispute informally. If you are a consumer and we cannot agree, you may use, free of charge, a consumer mediator, whose details we give you on request, as provided by Articles L611-1 and following of the French Consumer Code.
For business users, and subject to mandatory rules, the courts of Paris have exclusive jurisdiction.
19General
- Entire agreement. These Terms, with the documents they refer to, are the whole agreement about the Service.
- Severability. If a clause is held invalid, the rest stays in force and the clause is replaced by a valid one with the closest effect.
- No waiver. Not enforcing a right is not giving it up.
- Assignment. You may not transfer your account or rights. We may transfer ours to a successor of the business, with notice to you.
- Language. These Terms are written in English. If we provide a translation, the English text prevails unless the law of your country requires otherwise.
- Notices. We may notify you in the dashboard or on this page.
20Illegal content, notices and contact points
To the extent that Augis acts as an intermediary service under Regulation (EU) 2022/2065 (the Digital Services Act), the following applies.
- Contact point for authorities (Article 11): contact@augis.eu. You may write to us in English or French. Requests from authorities are handled as described on the law enforcement page.
- Contact point for users (Article 12): contact@augis.eu, by email, so that you can reach us quickly and directly.
- Notice of illegal content (Article 16): write to the same address with a sufficiently substantiated explanation of why you consider the content illegal, the exact location of it (an address or an identifier), your name and email address (unless the offence is one of those listed in Directive 2011/93/EU), and a statement that you act in good faith and that the information is accurate and complete. We confirm that we received it and we tell you our decision.
- Restrictions on your account (Article 17): if we restrict or end your account for illegal content or for breach of these Terms, we tell you the facts and reasons, unless the law forbids it, and how you can contest the decision.
